Representative Matters

Representation of a Leading Property and Casualty Insurance Company. Circuit Court of Cook County, Chancery Division: Trial of Illinois class action involving the exempt status of auto and casualty adjusters under the Illinois Minimum Wage Act (provisions mirror the Fair Labor Standards Act). Complete defense verdict after three-week bench trial; affirmed on appeal.

Bettina M. Whyte v. PricewaterhouseCoopers LLP. Represent PwC in accounting malpractice lawsuits asserted by litigation trustee of one of the country's largest private midstream oil companies, and by certain of the company's former investors, claiming losses in excess of $2 billion. Representation is ongoing.

Tenens Corp. v. PricewaterhouseCoopers LLP. Represented PwC in accounting malpractice lawsuit by former client defrauded by its own CFO. Case settled favorably on the eve of trial.

Madoff Litigation. Represent PricewaterhouseCoopers, LLP (Canada) in New York federal and state court suits arising from audits of largest fund to have invested with Bernard Madoff. Cases are ongoing.

Insurance Brokerage Antitrust Litigation. Represented Aon Corp. in putative class action alleging antitrust claims related to the receipt of contingent commissions. Obtained dismissal in trial court, largely affirmed on appeal by the Third Circuit. Case settled favorably thereafter.

In re Linerboard Antitrust Litigation. Successfully represented defendant in class actions and thousands of opt-out cases alleging a corrugated price-fixing conspiracy.
