Andrew C. Phelan

Andy Phelan is a partner in the Antitrust and Trade Regulation group and an experienced trial lawyer who represents companies in a broad range of business disputes and investigations, including allegations of illegal or anticompetitive conduct where the client seeks a pragmatic approach by someone with the skills not only to litigate a case, but to take it to trial. He brings to bear his substantial experience as a government prosecutor when handling government investigations and subpoenas. Andy’s broad experience and ability to take cases to trial substantially improve the end result for clients, whether by settlement or in court. He has handled numerous internal investigations, has substantial TRO and preliminary injunction experience, tried dozens of cases in state and federal courts, arbitrated domestic and international cases, and handled numerous state and federal court appeals.

Andy serves a broad range of clients, including banks, manufacturers, retailers, professional sports teams, investment firms, partnerships, joint ventures and individuals. His substantive knowledge and experience includes business torts, antitrust, contract law, fraud, false claims, equitable claims, commercial law, securities, real estate, project finance, construction disputes, insurance claims and disputes, government investigations, antitrust regulation, including in the healthcare, pharmaceutical and other fields.

After clerking for Chief Judge Royce Lambert of the U.S. District Court in Washington, D.C., Andy was a trial lawyer for the U.S. Department of Justice, where he represented clients in courts across the United States, including executive branch officials, the FBI, CIA, SBA and other agencies. As a federal prosecutor, he investigated, indicted and prosecuted crimes in state and federal trial and appellate courts, including offenses under RICO and for such other offenses as conspiracy, murder, narcotics, weapons, car theft, stalking, violent crimes and domestic violence.
