Andrew M. Smith

Andrew Smith concentrates his practice on retail financial services, credit reporting, privacy, technology and e-commerce issues. He assists banks, insurers, non-bank lenders, credit bureaus, technology companies, and their vendors with regulatory compliance, litigation and transactional matters.

Mr. Smith often represents clients before federal and state agencies—particularly the FTC and CFPB—in law enforcement and rulemaking proceedings. He regularly advises companies on the requirements of the GLBA, FCRA, DPPA, ECOA, FDCPA, TCPA and TSR, FTC Act, Dodd-Frank Act, and analogous state laws, including state insurance privacy laws and security breach notification requirements.

Mr. Smith is a Fellow of the American College of Consumer Financial Services Lawyers, and is recommended as a leading lawyer by Best Lawyers in America, Chambers, and Legal 500.

An active member of the American Bar Association, Mr. Smith is currently the vice-chair of the ABA's Consumer Financial Services Committee. He previously served as chair of the ABA Task Force that successfully challenged the FTC's application of its Red Flags Rule to the legal profession.

Prior to Joining Morrison & Foerster, Mr. Smith served in senior supervisory and policy-making positions at the FTC and the Securities and Exchange Commission. At the FTC, he led a team of 45 professionals to develop and draft ten rules and six studies under the Fair and Accurate Credit Transactions Act of 2003 ("FACT Act").

While earning his degree at William & Mary Law School, Mr. Smith was the Professional Articles Editor of the William and Mary Law Review.
