Anthony L. Fletcher

Senior Principal Tony Fletcher is resident in Fish & Richardson’s New York office. He specializes in trademark litigation, counseling and prosecution, with emphasis on trade dress and trademark survey matters. He began his trademark work in 1966, and has practiced trademark law and such related fields as copyright, false advertising and right of publicity virtually exclusively since 1971.

“Business today, and as long as I can remember, is, and has been, intensely competitive. I have always viewed my mission to be to win for my clients, whether that requires negotiating, mediation, or defeating rivals in court, minimizing damage in battles that for some reason need to be fought to defeat, or simply ignoring or conceding possible battles that can’t be won.”

During his trademark career, Tony has written extensively for the preeminent law journal, The Trademark Reporter, with 28 articles and case reviews totaling more than 1,700 pages. His article, “The Product with the Parody Trademark: What’s Wrong with CHEWY VUITON?” won the International Trademark Association (INTA) Ladas Award for best trademark article of 2010. Recently, Tony contributed a chapter to the 2013 Thomson Reuters WESTLAW treatise International Trademark Dilution, titled “The Impact of Freedom of Expression on Dilution Enforcement in the United States.”

In 2003, Tony received INTA’s President’s Award for Lifetime Achievement. He has consistently been ranked by his peers as Top-rated AV® Preeminent™ in intellectual property law; one of the “Best Lawyers in America”; and a listing in The Legal Media Group’s “Guide to the World’s Leading Trade Mark Law Practitioners.”

Prior to joining Fish, Tony practiced at Simpson Thacher & Bartlett (1962-71), Conboy, Hewitt, O’Brien & Boardman (1971-1986) and Hunton & Williams (1986-1997), all in New York.
