Anthony MacDonald Caputo’s practice focuses on complex commercial, financial products, and securities related litigation in both state and federal courts. A leading Russian industrial conglomerate pursuing securities fraud claims for insider trading and market manipulation against a major United States investment bank stemming from the liquidation of a more than $1 billion dollar stake in a Canadian auto parts manufacturer.
A publically traded commercial finance company pursuing common law and statutory securities fraud claims in Texas in connection with subordinated debt financing arrangement.
Two investment advisory firms pursuing contract and other claims related to the improper redemption of certain bonds in violation of their governing indentures.
MBIA, the world's largest bond insurer, in multiple federal and state court actions brought by 19 of the world’s largest financial institutions, bondholders and a putative nationwide class represented by several hedge funds – all challenging MBIA’s $5 billion restructuring of its structured finance and municipal bond insurance businesses. On March 4, 2013, following a highly-publicized four-week hearing, New York State Supreme Court Justice Barbara R. Kapnick issued a decision upholding the approval of MBIA’s restructuring by the New York Department of Financial Services in every respect. In May 2013, MBIA reached settlements with Bank of America and Société Générale S.A., the only remaining bank plaintiffs challenging MBIA’s restructuring.
The Controlling Pre-LBO Bondholder-directed indenture trustee in Tribune Company.
Hilton Worldwide in an action alleging trade secret misappropriation brought by Hilton's competitor, Starwood Hotels & Resorts, and in a grand jury investigation conducted by the United States Attorney's Office (S.D.N.Y.), relating to the same underlying facts.
