Brett Berlin has a depth of experience with complex business disputes, corporate bankruptcy, and financial distress issues, including litigation, transactional, and advisory work. He has led or played significant roles in representations of chapter 11 debtors, creditors, bankruptcy litigation defendants, lease and contract counterparties, non-debtor plan proponents, and purchasers of distressed assets in cases in numerous jurisdictions. In addition, Brett has represented Firm clients in civil litigation in state and federal courts, including cases concerning breach of contract, contract interpretation, employment-related covenants, fraud and misrepresentation, letters of credit, the federal False Claims Act, and other complex commercial matters.
A few examples of these engagements include Bank of America (creditor, litigation defendant), AFA Investment (debtor), Borden Chemicals & Plastics (debtor), Banca Nazionale del Lavoro (creditor), Burlington Industries (debtor), Chrysler/Old Carco (debtor), Dana Corporation (debtor), GAF Materials Corporation (creditor, asset acquisitions), Georgia Gulf Corporation (restructuring, creditor, asset acquisitions), International Specialty Products (creditor, avoidance action defendant), the Orbital Imaging Corporation Unsecured Creditors Committee, Pillowtex (debtor), and The Southern Company (avoidance action defendant).
Brett is a member of the American Bankruptcy Institute, the Turnaround Management Association, and a Board Member at Large of the Bankruptcy Section of the Atlanta Bar Association. Since summer 2003, he has served on the advisory board for the Emory University Bankruptcy Developments Journal. He is a regular participant in the Credit Abuse Resistance Education Program for high school students and the Atlanta Bar Association's pro bono Reaffirmation Project for unrepresented consumer debtors.
