Mr. Fergemann counsels major national consumer product companies and retailers and their advertising and promotion agencies on a wide range of advertising, marketing, social media, e-commerce, and general intellectual property issues. Mr. Fergemann also has extensive experience advising clients in negotiating and drafting agency-client agreement, high-level talent agreements, and sponsorship agreements.
In addition to counseling, Mr. Fergemann has represented clients in connection with governmental investigations by the Federal Trade Commission and various state attorneys general involving allegations of false advertising and deceptive or unfair business practices, and has represented numerous clients before the National Advertising Division (NAD) of the Council of Better Business Bureaus.
Mr. Fergemann is the editor of the firm’s Advertising, Marketing and Privacy Law News blog. He is also legal counsel to the Chicago Advertising Federation and represents the firm in its association with AdLaw International, an international association of preeminent advertising and marketing attorneys.
Mr. Fergemann is also a regular speaker on advertising issues at national and international advertising and marketing law conferences.
Mr. Fergemann received a B.A., cum laude, from Michigan State University in 1996 and a J.D. from the University of Virginia School of Law in 1999, where he was on the editorial board of the Virginia Journal of International Law.
Mr. Fergemann is Vice Chair of the Board of Directors of The Night Ministry, a non-profit organization that serves homeless youths and adults in Chicago.
