Brian Kao

Brian Kao joined Ropes & Gray in 2007 as an associate in the Intellectual Property Group. Brian’s practice focuses primarily on patent infringement litigation in wide-ranging fields of technologies. He has represented and counseled clients in disputes relating to cellular telephones, software, VOIP telephones, consumer appliances, pharmaceuticals, mechanical inventions, and geosciences. Brian has significant litigation experience, both at the district court level and on appeal, including the handling all aspects of discovery, drafting motions and briefs, preparing expert reports, taking and defending fact and expert depositions, and drafting settlement agreements. Brian also has experience preparing patent reexaminations.

In addition to patent litigation, Brian has also advised clients on the IP-related aspects of corporate transactions, including freedom to operate assessments and risk management advice.

Prior to joining Ropes & Gray, Brian worked as a Product Engineer at Corvis Corporation, a telecommunications equipment provider of optical transmission, amplification, and switching systems. While in university, he worked as an Engineer’s Assistant at an oil refinery. His varied work experience enables him to quickly grasp different technologies, and to understand the operation of companies, both from a design and manufacturing standpoint as well as from a business standpoint.

Brian’s pro bono practice includes the ongoing representation of the co-founders of Transactional Records Access Clearinghouse, a data gathering, research and distribution nonprofit organization at Syracuse University, in a Freedom of Information Act (FOIA) suit against the Civil Division of the Department of Justice. Long and Burnham v. U.S. Dept. of Justice, Civil Action No. 06-1086 (NAM) (N.D.N.Y.).

In 2005, while in law school, Brian was a judicial extern in the chambers of the Honorable David O. Carter, U.S. District Court, Central District of California.
