Catherine A. Hurley

Katie is a Senior Associate in the Life Sciences Health Industry Group, specializing in health care regulatory matters. Her work focuses on fraud and abuse issues, regulatory compliance, and Medicare reimbursement counseling. Katie represents health care service providers (such as all types of acute and post-acute institutional providers, clinical labs, pharmacies, hospices, and DMEPOS suppliers), as well as drug and device manufacturers, and her practice covers a wide range of complex regulatory matters ranging from government health care fraud investigations to Medicare and Medicaid reimbursement litigation.

Katie has particular experience with health care anti-fraud laws, such as the federal anti-kickback statute and related prohibitions under federal and state law and the physician self-referral or Stark law. She also has extensive experience with compliance policy drafting and implementation, corporate integrity agreement (CIA) negotiation and compliance, patient financial assistance programs (PAPs), transaction planning and change of ownership (CHOW) issues (including licensing and reimbursement implications), Medicare as secondary payer (MSP) issues, regulations pertaining to health information technology and electronic health records, Medicare enrollment issues, Medicaid financing issues (such as supplemental payment programs and provider tax and donation programs), requesting advisory opinions from the U.S. Department of Health and Human Services, Office of Inspector General (OIG), and drafting proposed legislation. Additionally, she frequently handles regulatory due diligence, internal compliance and fraud investigations, contract review and negotiation, False Claims Act/qui tam defense, self-disclosures and overpayment refund issues, and advocacy related to various health policy issues on behalf of her clients.
