Cheryl A. Mitchell

Cheryl is a partner in the Litigation Department of Reed Smith's New York office. Cheryl focuses her practice on complex commercial litigation, product liability litigation, financial services litigation, pharmaceutical and medical device litigation, data privacy issues, class actions and mass torts.

Cheryl's client base consists primarily of fortune 500 companies from a variety of industries, including consumer products, financial services and producers of pharmaceutical and mechanical products. Cheryl represents a number of multi-national clients involved in cross-border litigation and has specialized knowledge handling issues relating to EU privacy laws. Her commercial litigation experience includes representing companies in complex business contractual disputes, join venture disputes, and supplier/vendor disputes. Cheryl also represents brokerage companies, banks and other financial services institutions in securities fraud cases, shareholder disputes and general commercial cases and litigates claims arising from disputes among officers and directors, breach of partnership agreements, common law fraud and breach of fiduciary duties.

Cheryl's experience further includes representing companies in employment related claims involving Title VII discrimination claims, the Americans with Disabilities Act, the Family and Medical Leave Act, as well as a variety of claims stemming from breaches of employment agreements.

Cheryl has extensive experience litigating cases on behalf of pharmaceutical, medical device and consumer products companies including failure to warn claims, consumer fraud claims, and claims alleging improper marketing practices. Many of her cases involve product recalls resulting in nationwide/regional class actions and mass tort litigation. Cheryl has served as trial counsel in single-plaintiff as well as mass tort cases, including most recently representing a major pharmaceutical company in a jury trial where the ultimate injury alleged was death due to primary pulmonary hypertension.

Cheryl possesses specialized knowledge in the area of electronic discovery and counsels clients on issues involving the preservation and production of electronically stored information. She also counsels clients on setting up appropriate document retention and preservation policies, including the appropriate procedure for the implementation of litigation holds. Cheryl has extensive knowledge in the area of cross-border document preservation and production. She further litigates claims involving data security breaches and is a member of the firm’s Data Privacy Group.
