Cynthia D. Driscoll

Cynthia Driscoll practices in the area of complex litigation, with extensive experience in nationwide toxic tort and product liability litigation. Her practice also involves national and international product recalls, occupational health and safety, and environmental counseling. Cynthia's Ph.D. and extensive toxicology experience, including research and management positions as an industrial toxicologist with Dupont and Union Carbide prior to law school, provide a unique approach to the analysis of issues emerging from the nexus of science and the law. She counsels and defends clients in matters involving chemicals, drugs, and other potentially toxic agents. She works with experts in a variety of disciplines related to the assessment of child and adult health effects, including pediatrics, toxicology, neuroscience, clinical psychology, cognitive assessment, epidemiology, statistics, risk assessment, industrial hygiene, occupational medicine, chemistry, medical historians, oncology, radiology, pathology, and gerontology.

Cynthia represents The Sherwin-Williams Company in its lead paint and pigment litigation throughout the country. These suits involve product liability, market share liability, and public nuisance claims. Since 2007, she has represented Mattel and Fisher-Price in investigations and claims arising from the voluntary recall of toys, and in connection with the adoption and implementation of the Consumer Product Safety Improvement Act of 2008 (CPSIA). She also represents Laboratory Corporation of America (LabCorp) in professional negligence litigation related to LabCorp's human papilloma virus (Pap smear) testing and counsels clients on the Occupational Safety and Health Administration's (OSHA) Hazardous Communication Standard (HCS) and Mine Safety and Health Administration regulations (MSHA).
