Daniel J. Morse

Dan Morse focuses his practice on the defense of general liability and casualty cases involving personal injury and property damage claims. Dan has particular experience litigating security guard liability matters as well as general, premises, construction and automobile liability claims and related contractual disputes.

Dan defends security guards accused of using excessive force or failing to act to prevent injuries to persons on the premises where they were providing guard services. On behalf of property owners and general contractors, Dan defends claims arising from construction site, elevator and trip-and-falls accidents as well as alleged construction defects. His experience includes fire loss matters involving catastrophic personal injury and property damage claims. He also defends subrogation claims for property damage or personal injuries resulting from alleged acts of negligence.

Through his work responding to and managing crisis situations, including interviewing potential witnesses and documenting damages, Dan not only preserves the evidence needed to appropriately defend any ensuing litigation but also gains familiarity with his clients’ operations. Dan also provides clients with proactive review and analysis of construction, security and maintenance contracts before they are entered to ensure that any issues with respect to indemnification and third-party beneficiaries have been addressed. He litigates claims for breach of contract, indemnification and defense as well.

Recently Dan completed a six-month assignment as an assistant district attorney in Kings County, NY, providing pro bono representation in criminal trials as part of the Partners in Prosecution program. Drawing on the trial experience he gained from this program, Dan approaches litigation with a focus on the comprehensive evaluation of all potential issues and the formulation of a defense strategy consistent with client’s end goal.
