David E. Fletcher

Dave Fletcher is Special Counsel in the Government Contracts practice group. He rejoined the Firm in 2013 and is resident in the Washington, DC office.

Mr. Fletcher advises clients on a variety of legal and contractual matters related to their government business, including the meaning and effect of FAR and agency FAR supplement clauses, prime contractor/subcontractor negotiations and disputes, domestic preferences and domestic source restrictions (for example, the Buy American Act ("BAA") and Trade Agreements Act ("TAA")), GSA Schedule and other commercial item contracts, and government contractor compliance obligations. Mr. Fletcher focuses his counseling practice on small business assistance programs in federal contracting, including the 8(a) Business Development, Small Business Innovation Research ("SBIR"), Service-Disabled Veteran-Owned ("SDVO"), Historically Underutilized Business Zone ("HUBZone"), and Women-Owned Small Business ("WOSB") programs. Mr. Fletcher also counsels clients on mergers and acquisitions involving government contractors, including the transaction-specific application and potential effect of small business rules.

Mr. Fletcher files and defends bid protests at the U.S. Government Accountability Office, the U.S. Court of Federal Claims, and agency-level protest forums, and represents clients in size protests and size appeals before SBA Area Offices and the SBA Office of Hearings and Appeals.

Prior to rejoining Cooley, Mr. Fletcher was in-house government business counsel for a large defense contractor.

Mr. Fletcher received his J.D. cum laude from the University of Illinois and his A.B. from the College of William and Mary. He is a member of the Virginia State Bar and the District of Columbia Bar.
