David S. Rutkowski

David Rutkowski represents clients in a variety of litigation matters, including toxic tort, products liability, RICO, unfair trade practices, and trademark and copyright infringement claims, with a focus on toxic tort and products liability litigation. His practice also includes internal investigation and counseling on matters involving the Foreign Corrupt Practices Act and other white-collar crime.

David's recent representations include counseling and negotiating resolutions to potential liabilities stemming from performance issues associated with the products of suppliers of solar energy system components. He represented Wyeth Pharmaceuticals in nationwide products liability litigation involving Wyeth's antidepressant drug, Effexor, earning a unanimous defense verdict for Wyeth in 2007 against wrongful death allegations involving failure to warn and misrepresentation claims — the first case of its kind against the antidepressant industry to go to trial in more than six years. David was also extensively involved in defending IBM in cases brought in California and New York by more than 200 current and former employees alleging various adverse health effects due to workplace exposure to chemicals and was part of the team that earned a unanimous jury verdict for IBM in the first of these cases to go to trial. He currently defends other semiconductor manufacturers against similar allegations that workplace exposures resulted in birth defects and other health outcomes in the children of former employees.
