Dwayne C. Norton focuses his practice on intellectual property matters, with particular emphasis on patent litigation. Dwayne has significant experience in cases involving various technologies, including telecommunications, wireless/wired networks, display devices, computer electronics and software, audio signal processing, smart meters, various industry standards, including IEEE, GSM, and WCDMA, and nutraceutical/medical food products. Dwayne has litigated cases in a number of forums, including the International Trade Commission (ITC), and district courts in California, Delaware, Illinois, Nevada, New York, North Carolina, Texas, Virginia, and Wisconsin. In addition, he has participated in proceedings before the Patent Trial and Appeal Board (PTAB), including Inter Partes Review (IPR) proceedings. Prior to joining Chen Malin, Dwayne was an attorney for a large national firm, first in Charlotte, North Carolina, then most recently in Dallas, Texas.

Dwayne brings a unique set of skills, developed during his almost decade long practice at a large national firm, to his practice at Chen Malin. Dwayne has taken and defended dozens of depositions, had primary responsibility for the technical aspects of cases, including infringement and invalidity analyses, worked with experts to prepare and rebut technical and non-technical expert reports, prepared numerous motions, including case dispositive and claim construction (Markman) motions, prepared cases for trial, and participated in trials with successful outcomes for his clients. With his background and experience, Dwayne can work a case from beginning to end, providing day-to-day case management as well as case directional strategic advice.

Representative Matters:

Litigation counsel for patentee/branded product owner in patent litigation/Lanham Act cases related to nutraceutical/medical food products. Primary responsibility for preparing and presenting damages case at bench trial, resulting in treble damages award for client.
Patent litigation counsel to one of the world's largest electronics providers in patent cases in federal district courts, including Texas, Delaware, and California. Responsibilities included managing day-to-day matters in multi-patent litigation.
Participate in IPR proceedings, including expert and fact witness discovery and depositions. Particularly involved in addressing issues related to secondary considerations of non-obviousness, including commercial success and copying in marketplace.

Events:

Dwayne has presented on patent issues before a wide range of audiences, including the State Bar of Texas 26th Annual Advanced Intellectual Property Law Course (February 2013), the Dallas Bar Association Intellectual Property Law Section (June 2014), and the Center for America and International Law (CAIL) 52nd Annual Conference on Intellectual Property Law (November 2014).
