Glen R. Stuart is a partner in Morgan Lewis's Litigation Practice. Mr. Stuart's complex commercial litigation practice focuses primarily on environmental law, toxic torts, and energy matters.
In the environmental field, Mr. Stuart has successfully defended a former property owner in a two-week trial of a private cost recovery action under CERCLA; pursued and defended third-party contribution claims; defended property diminution claims involving extensive expert testimony; negotiated consent decrees; provided counsel throughout the design and construction of two of the first CERCLA response actions funded through mixed funding; and represented companies in the defense and settlement of natural resource damage claims.
Mr. Stuart's practice has focused on the defense of common law and contractual claims associated with the claims made under environmental statutes. Mr. Stuart has defended landfill-related toxic tort and property diminution claims in the federal courts of the Third Circuit. Mr. Stuart is also actively involved in the defense of toxic tort conspiracy cases, including such cases in the state and federal courts of Florida, Kentucky, Massachusetts, Michigan, New Jersey, Ohio, Texas, and West Virginia.
In the energy field, Mr. Stuart has represented utilities in proceedings before the Pennsylvania Public Utility Commission and the Federal Energy Regulatory Commission, as well as state and federal court litigation. Mr. Stuart successfully argued on two occasions before the Third Circuit to affirm the dismissals of federal antitrust claims against utilities.
Mr. Stuart is listed in Chambers USA: America's Leading Lawyers for Business (2004–2014), The Best Lawyers in America (2008–2015), and is listed as a "Pennsylvania Super Lawyer" in Philadelphia Magazine (2004–2006; 2009–2013). In a nationwide survey of more than 185 corporate counsel of Fortune 1000 companies conducted by BTI Consulting Group in 2002, Mr. Stuart was one of only 21 lawyers in the entire U.S. recognized for exceptional client service two years in a row.
Mr. Stuart also has experience with environmental insurance litigation, including representing a policyholder in litigation of a multimillion dollar environmental insurance claim in Delaware state court.
He also has handled a variety of tort claims, including the successful defense in a Philadelphia County jury trial of a $2 million negligence action, and health care law issues, including the successful appeal to Pennsylvania Commonwealth Court of a $20 million judgment arising out of a client's statutory conversion of an HMO from nonprofit to for-profit.
Mr. Stuart has represented and continues to represent clients in a variety of industries, including pharmaceutical, chemical, electric utilities, truck leasing and health insurance.
Mr. Stuart is admitted to practice in Pennsylvania and before the U.S. Supreme Court, the U.S. Court of Appeals for the Third Circuit, and the U.S. District Courts for the Eastern and Middle Districts of Pennsylvania.
