Gregory S. McCue

Greg McCue is of counsel in Steptoe's Washington office, practicing in the firm's International Trade Department. While studying for his law and graduate degrees, Mr. McCue held law and policy clerkships with the Department of State, US Embassy in France, the United Nations High Commissioner for Refugees, and the Department of Justice, Office of International Affairs.

Mr. McCue has extensive experience in Customs and International Trade law and has represented clients in litigation before the Court of Appeals for the Federal Circuit and the Court of International Trade. He has also represented importers, exporters, surety companies, and customs brokers in agency actions and the presentation of policy and rulemaking positions before the US Customs and Border Protection and related agencies. On behalf of these clients, he has requested binding rulings from Customs, prepared and filed protests and prior disclosures, as well as presented petitions for cancellation or mitigation of fines, penalties, seizures and claims for liquidated damages. Mr. McCue has advised these clients in matters involving tariff classification, valuation, country of origin determination and marking, entry procedures and the application of duty-reducing programs such as North American Free Trade Agreement, the Generalized System of Preferences, Caribbean Basin Economic Recovery Act, and the US-Israel Free Trade Agreement. He has also provided advice to importers and exporters on the international trade impact of the regulations of numerous agencies, such as the Food and Drug Administration, the Bureau of Alcohol, Tobacco and Firearms, and the Department of Transportation.

Mr. McCue regularly advises importing clients on the uses and procedures for various types of Customs bonds, especially in connection with imports that may be subject to special requirements such as antidumping or countervailing duties. He works with these clients on the correct amount and cost of such bonds and on the necessary relationships with private surety companies and US Customs.

Mr. McCue has counseled clients on trade issues arising out of the US antidumping and countervailing duty statutes, as well as bilateral and multilateral relationships with various US trading partners to the General Agreement on Tariffs and Trade and the World Trade Organization. He has also worked with industry groups in the establishment of trade associations focused on issues of international trade regulation and the representation of these associations before US courts and agencies.

Mr. McCue actively participated in the litigation surrounding the challenge to the Harbor Maintenance Tax ("HMT") under the Export Clause of the US Constitution. He has advised clients regarding the Constitutional, statutory, and regulatory issues arising from the HMT case, such as administrative procedure, the applicable jurisdiction of various federal courts, calculation and filing of refund claims, and the ramifications of successive decisions in the case by the Court of International Trade, the Federal Circuit, and the US Supreme Court.
