Heather Nicole Fugitt

Heather Fugitt's practice focuses on intellectual property litigation, including substantial experience in the computer software, semiconductor, and telecommunications spaces. She has represented clients in patent and copyright infringement cases and in cases involving computer trespass and fraud claims and trade secret claims.

Heather has extensive experience in all aspects of litigation, including significant trial experience. She has been a member of five trial teams, including two that proceeded to a jury verdict and three that settled favorably for her clients just prior to jury selection. She has coordinated and supervised the pretrial filing process; briefed successful pretrial motions, including motions in limine and Daubert motions on damages and evidentiary issues; and has participated in all aspects of trial preparation, including preparing pretrial filings, drafting direct and cross-examinations for key witnesses at each trial, preparing expert witnesses to testify, and drafting successful post-trial briefing. In one matter, Heather was one of the key drafters of the briefing for a specially set omnibus evidentiary hearing, at which her client prevailed on almost every evidentiary issue presented to the court.

Heather has participated in all phases of litigation, from prelitigation counseling through fact and expert discovery. She has experience in, among other things, e-discovery, motion practice, depositions, working with fact and expert witnesses, and summary judgment.

Heather also has advised clients on a variety of issues related to web site agreements, terms of use, and other internet agreements. She also has helped clients with enforcement of their trademarks in the internet space.
