Henry M. Baskerville

Henry Baskerville, of counsel to the Litigation practice group, is an experienced trial attorney who focuses on white collar criminal, complex commercial cases, labor and employment, and higher education.

In the white collar area, Henry handles both the defense at trial and appeal of bank, mail, securities and tax fraud matters, as well as public corruption charges.

As part of his practice, Henry conducts internal investigations of entities and institutions concerned about potential violations of the law or those that are already facing government probes. When a wrongdoing is detected, Henry examines the nature and extent of the issue. He conducts employee interviews, reviews business records and consults with management to determine the best strategy. He also assists businesses in setting up compliance programs that provide policies and procedures aimed at eliminating potentially unlawful conduct.

In the commercial litigation area, Henry is experienced in many aspects of trial practice and has represented numerous individual and corporate clients in a wide variety of disputes, including breach of fiduciary duty, fraud, fraudulent transfers, alter ego, False Claims Act claims, breach of contract, franchise law, labor and employment disputes, insurance coverage, class action consumer cases, construction litigation, government contracting, securities and bankruptcy and receivership proceedings. He has represented plaintiffs, defendants, bankruptcy trustees and court appointed receivers in State and Federal trial and appellate proceedings.

Henry is experienced in helping companies with various labor and employment issues. When problems arise, he has conducted internal investigations to help determine what went wrong and how personnel matters should be handled. He has counseled companies on how to legally and fairly terminate an employment relationship, and assisted with investigations from various state labor agencies. He has counseled companies from a wide variety of industries that are as diverse as banks, e-commerce companies, physician practices, and even golf courses. If litigation becomes necessary, he has extensive experience defending companies against a variety of claims including the following: wage and hour; retaliatory discharge: False Claims Act; employment discrimination; and those related to restrictive covenants and trade secrets.

Higher education is another area of his focus. In this part of his practice, Henry helps post-secondary education schools develop the appropriate policies and measures aimed at complying with state and federal laws, including Title IV, Title IX, the Clery Act, TILA and ADA. He also assists colleges by reviewing and providing counsel on advertising, publications and online information. If litigation becomes necessary, Henry assists in a wide-range of matters, including False Claims Act cases, mass action and individual arbitrations, class action lawsuits, state Attorney General investigations and consumer protection cases.

Henry also provides assistance to individuals and businesses in the legalized marijuana industry. He helps companies apply for and secure the necessary licenses to cultivate and dispense marijuana and its byproducts. In this area, Henry also provides general business advice, as well as guidance on state and federal regulations governing the operation of legalized marijuana businesses and the solicitation of and contracting with investors and other business partners.
