James H. Pulliam

Jim Pulliam focuses his practice on litigation and loan servicing matters relating to commercial mortgage-backed securities. Mr. Pulliam has extensive experience in the representation of financial institutions and special servicers in connection with distressed real estate loans and the disposition of commercial properties. This includes creditor representation related to non-performing commercial loans, involving the exercise of remedies, such as receiverships, judicial and non-judicial foreclosures, workouts, litigation and contested bankruptcy matters. Mr. Pulliam has protected lenders' interests in loans collateralized by retail, hospitality, office, industrial, multi-family and health care properties.

Mr. Pulliam has represented financial institutions in lender liability actions involving claims related to constitutional issues, breach of contract, fiduciary duty, implied duty of good faith, fraud, misrepresentation, partnership-joint venturer and waiver-estoppel modification. He has also represented parties in business disputes involving contracts, real estate, shareholder issues, construction deficiencies and unfair and deceptive trade practices. He practices in the state and federal forums, and before the American Arbitration Association panels. Mr. Pulliam is an experienced appellate advocate, having argued before the North Carolina Court of Appeals and the United States Court of Appeals for the Fourth Circuit.

Mr. Pulliam has been recognized as one of Business North Carolina's 2008 “Legal Elite” in Litigation and Bankruptcy Law. He is AV® rated by Martindale-Hubbell.
