Jason G. Winchester

Jason Winchester is a trial lawyer who has represented clients in a broad range of complex matters — including cases involving intellectual property, class actions, securities, and constitutional challenges. In addition to trying cases to successful verdict in federal and state courts, Jason has protected clients' interests in numerous appeals.

Recently, Jason and a Jones Day team represented R.J. Reynolds Tobacco Company in an arbitration proceeding against dozens of states, relating to the states' performance of their obligations under the Master Settlement Agreement. The Jones Day team handled nine trials and achieved a significant recovery for the client. Jason also represented Potash Corporation of Saskatchewan Inc. in its successful defense of a $40 billion hostile tender offer from mining giant BHP Billiton. In the field of intellectual property litigation, Jason has been counsel for innovator pharmaceutical companies in more than 30 patent infringement actions brought under the Hatch Waxman Act, involving significant products such as AndroGel, Depakote, Revlimid, Focalin, Ritalin, Nimbex, and Prezista. He also has substantial experience defending companies in qui tam actions arising under the False Claims Act. In addition to preparing such matters for trial, he has handled the complex negotiation and implementation of global settlements. Outside the courtroom, Jason advises clients about matters involving regulatory bodies such as the Food and Drug Administration and the U.S. Pharmacopoeia.

Jason serves on the Firm's Recruiting Committee and as the Chicago trial practice associate coordinator. Outside the office, he and his family work to advance research and awareness of childhood stroke and cerebral palsy.
