Jeff D. Bernarducci concentrates his practice within the construction, energy and commercial real estate industries. He serves a varied client base in these industries, including general contractors (regionally and nationally based), real estate developers, real estate investment funds, universities, owner representatives, sureties, specialty subcontractors and engineers.
Mr. Bernarducci’s general corporate and transactional practice includes drafting and negotiating commercial construction contracts for vertical construction and civil utility projects, letters of credit, promissory notes, leases, indemnity agreements, owner-representative consulting agreements, project close-out resolutions, multi-party escrow agreements at commercial property closings, non-disclosure and confidentiality agreements, material purchase orders, and complex litigation settlements. Mr. Bernarducci also provides daily advice to clients involving U.C.C. issues, corporate document-retention strategies, insurance issues (including E&O, Property, and Commercial General Liability policies), risk analysis and bankruptcy.
Mr. Bernarducci has also managed numerous large-scale, complex litigation matters arising from real estate finance deals (approximately $15 million in dispute), electric transmission-line reliability projects (approximately $25 million in dispute), surety work-outs (all sizes), and all forms of commercial construction projects (typically from $100,000 to $5 million in dispute). He has also lectured on various topics in the construction industry, including risk management and best practices for maximizing all available insurance products in the market.
During law school, Mr. Bernarducci was the Editor-in-Chief for the Suffolk Journal of Trial and Appellate Advocacy, and completed a federal clerkship at the United States Bankruptcy Court for the District of Rhode Island.
Mr. Bernarducci also currently serves as an Alumni Officer for the Phillips Exeter Academy Class of 1991.
