Jennifer L. Swize

Jennifer Swize focuses on appellate and complex civil litigation, with experience in a variety of industries and an emphasis on high technology companies. She has substantial experience in patent cases in district courts and the U.S. Court of Appeals for the Federal Circuit, and has argued before the U.S. Courts of Appeals for the First, Fourth, Sixth, and District of Columbia Circuits and before the U.S. District Court for the Eastern District of Virginia.

Jennifer's recent patent matters include the first successful defense of claims, on Section 101 patent-eligibility grounds, at the Supreme Court in over a decade (for Myriad Genetics, Inc.) and summary dismissal of infringement allegations based on patent exhaustion (for DIRECTV, LLC). Jennifer also has extensive experience in copyright, constitutional, environmental, and criminal law.

In her pro bono work, Jennifer represents a family from El Salvador persecuted by a gang that killed a family member not associated with the gang. After the Fourth Circuit issued a favorable decision on the family's asylum appeal that directed a remand, the government agreed to exercise prosecutorial discretion and permit administrative closure of the case.

Jennifer is a member of the Washington Office recruiting committee. She is also a member of the Edward Coke Appellate Inn of Court and has been a guest speaker and author on appellate practice and patent issues.
