Representing the DIP lenders to Blockbuster Inc. with respect to their $125 million DIP loan to the company.
Representing a large commercial demolition company in a successful out-of-court debt exchange and pre-packaged plan solicitation that restructured $325 million of indebtedness.
Representing the agent for the pre-petition and DIP lenders in the Lake Las Vegas bankruptcy. This representation involved a $127 million DIP loan and the restructuring of over a billion dollars of secured and unsecured claims through a successful chapter 11 plan of reorganization.
Representing the agent for the pre-petition lenders in the Promontory bankruptcy case.
Representing the second lien lender in Century City Doctors Hospital’s chapter 7 proceeding.
Representing The Flintkote Company, an entity with substantial asbestos related liabilities, in its chapter 11 case with respect to both its reorganization and the resolution of claims related to environmental contamination at several of its former manufacturing sites.
Representing the pre- and post-petition lender to a biofuels refinery. This representation involved providing DIP financing to the debtors, navigating a complicated auction process, and the sale of our client’s collateral in a transaction involving the assumption of a substantial part of its loans and the issuance of new financing.
Representing the agent for a syndicate of lenders in the liquidation of two affiliated power companies through state law proceedings in California and Wisconsin.
Representing the owner of a real estate development in protracted litigation defending their acquisition of a development through a chapter 11 plan. The litigation ultimately resulted in dismissal of the challenge to the sale and the successful prosecution of sanctions against the plaintiff and its counsel of approximately $160,000.
Prior to joining the firm, Mr. Rosenthal was an associate at an international law firm where he practiced in the real estate and business reorganization transactions group.
