Jessica R. Bernanke is a senior attorney in Morgan Lewis's Employee Benefits and Executive Compensation Practice. Ms. Bernanke focuses her practice on the management and administration of health and welfare benefit plans. She provides comprehensive advice regarding compliance issues related to ERISA, COBRA, the Affordable Care Act, and HIPAA/HITECH; negotiates service agreements on behalf of health and welfare benefit plans; provides on-site and webinar-based HIPAA training; and assists clients with establishing on-site clinics. Her practice includes single-employer and multiemployer plan clients.
As part of her employee benefits experience, Ms. Bernanke has litigated ERISA "401(k) stock drop," "claims for benefits," and withdrawal liability cases. Ms. Bernanke has also litigated commercial and products liability cases and participated in labor arbitrations as a member of the firm's Litigation and Labor and Employment Practices, and, prior to joining Morgan Lewis, she was associated with a litigation boutique law firm in New York City.
Following law school, Ms. Bernanke was a law clerk for Judge Thomas C. Platt of the U.S. District Court for the Eastern District of New York. Before law school, she worked as a legislative assistant to Congressman Hamilton Fish, Jr.
Ms. Bernanke received her J.D. from the College of William & Mary, Marshall-Wythe School of Law in 1994. She received her B.A., cum laude, from Boston College in 1989.
