John Foust's practice focuses on litigating and arbitrating complex disputes that arise from construction, infrastructure, and energy projects, both in the United States and internationally. He represents developers, owners, contractors, and major equipment manufacturers in connection with all manner of claims, including schedule disputes, defective work claims, change order and extra work claims, payment claims, and post-completion warranty claims. He also drafts and negotiates construction agreements.
John has experience with a wide variety of domestic and international projects, including power plants, pipelines, wind turbines, solar farms, pharmaceutical plants, hospitals, hotels, casinos, bridges, mining projects, and high-rise buildings. Recently, he and his colleagues represented MGM Resorts International and its joint venture partner Dubai World in what began as a $1 billion contract dispute over the construction of the $8.5 billion CityCenter project in Las Vegas. He also represents Lennar Corporation in connection with a multibillion dollar redevelopment of the former Hunters Point Shipyard in San Francisco.
John is a member of the ABA Forum on the Construction Industry, where he sits on the steering committee for the International Construction Division.
