Joshua C. Toll

is counsel with the Special Matters and Government Investigations team in King & Spalding’s Washington, D.C., office. He focuses on government investigations, white collar criminal litigation, complex civil litigation, internal investigations and compliance counseling. He has represented clients across a variety of industries, including automotive, energy, manufacturing, finance, and healthcare, in complex civil and criminal investigations, and has a wealth of experience representing clients who have received grand jury subpoenas focusing on sales and marketing practices. He regularly advises clients on a variety of civil and criminal issues, including compliance with various healthcare statutes, the Foreign Corrupt Practices Act, antitrust compliance, and various financial regulations. He has defended both corporations and individuals in prosecutions and investigations by U.S. Attorneys’ Offices, multiple divisions of the Department of Justice, the SEC, FDA, IRS and other federal agencies, and Congressional committees. In 2010, he was an integral member of a team of lawyers who represented Toyota in investigations and hearings by three separate Congressional committees relating to allegations of unintended acceleration.

Mr. Toll is also Pro Bono Counsel for the firm and is in charge of the firm’s overall pro bono program across all offices. Prior to January 1, 2013, Mr. Toll was Chairman of the Pro Bono Committee for King & Spalding’s Washington D.C. office. Under his leadership, the office has had a number of very notable victories, and has been recognized by the United States Court of Appeals for the D.C. Circuit, among other organizations, for outstanding pro bono achievement in 2011.

Mr. Toll has extensive experience in both criminal and complex civil litigation in state and federal courts. Immediately prior to joining King & Spalding, he was a trial attorney with the Office of the Public Defender of Maryland from November 2002 through June 2006, where he took over seventy-five cases to trial in various state courts in Maryland. In that capacity, he successfully litigated various constitutional and state criminal law issues, and developed wide-ranging expertise negotiating favorable outcomes for clients in difficult and complicated cases. Prior to his service as a public defender, Mr. Toll worked at another law firm in Washington, D.C., where he focused on complex civil litigation in federal and state courts at both the trial and appellate levels, including class actions, collective actions, and multidistrict litigation, antitrust matters and white collar criminal defense. He took and defended numerous depositions in cases with complex civil and constitutional claims, and argued motions in federal court.

Mr. Toll received his Juris Doctorate from Harvard Law School, cum laude, and his undergraduate degree from Cornell University with distinction. He is a member of the District of Columbia Bar, the State Bar of Maryland, and is admitted to practice in the United States District Court for the District of Columbia.
