Paul A. Weissman

An accomplished litigator who offers his clients a 360˚ view of the law, Paul A. Weissman is a hands-on lawyer who has successfully combined his years as a prosecutor of high-profile white-collar cases with extensive in-house experience defending pharmaceutical giants Schering-Plough Corporation and Merck & Co. in both criminal and civil matters.

During Paul’s 20-year tenure as an Assistant U.S. Attorney in the U.S. Attorney’s Office in New Jersey, he served as Chief of the Financial Institution Fraud Unit and Deputy Chief of the Fraud Division, conducting and/or supervising the prosecution of numerous significant securities, tax, bank and healthcare fraud cases. After leaving the U.S. Attorney’s Office, Paul spent more than a dozen years in the pharmaceutical industry, first as Schering-Plough’s Staff Vice President for Compliance prior to its 2009 merger with Merck & Co. and subsequently as a Managing Counsel at Merck. As in-house counsel, he was on the front lines overseeing major DOJ, state attorney general and SEC investigations, supervising commercial litigation matters, advising the companies on compliance activities, and conducting internal investigations. Having managed teams of outside lawyers, he knows what it’s like to be a consumer of legal services and brings that perspective to his work for Lowenstein clients.

Paul recognizes that although companies sometimes face similar legal issues, the truth is in the details, which require careful analysis and attention to his clients’ unique situations. He ably counsels his clients on the complexities of commercial litigation and guides them through sensitive internal corporate investigations. He is intimately familiar with the legal issues that pharmaceutical companies regularly encounter under state consumer fraud statutes, the federal Anti-Kickback Statute, the federal and state False Claims Acts, pharmaceutical pricing statutes, and the antitrust and securities laws.

Before he attended law school, Paul was a candidate for a Ph.D. in history, and he has retained his interest in teaching and writing. For 20 years, he taught a self-designed course on the legal theory and historical development of white-collar prosecutions as an Adjunct Professor at Seton Hall Law School, and he is currently researching a scholarly article in this area. He has also reviewed books on legal and other subjects for The New York Times Book Review.
