Thomas J. Sullivan

Thomas J. Sullivan is a partner in Morgan Lewis's Litigation Practice. Mr. Sullivan's practice encompasses a broad range of commercial and product related litigation in state and federal trial and appellate courts. He has counseled and defended clients in a variety of industries in putative class actions, mass torts, and in other complex commercial litigation. He has represented numerous life sciences and health care companies in cases involving alleged fraud of state and federal health care programs under false claims act statutes (including qui tam provisions), lawsuits by State Attorneys General, consumer fraud litigation, products liability claims, disputes regarding collaboration and development agreements, real estate transactions, and indemnity obligations. Mr. Sullivan's work has often involved defending companies in putative class actions, including alleged claims for consumer fraud, breach of contract, invasion of privacy, antitrust and unfair competition, RICO, ERISA, product liability, and securities. A significant amount of his work has been in parallel with state and/or federal criminal investigations. He has also developed significant experience defending developers and financial institutions in commercial matters, as well as manufacturers in product liability and toxic tort matters, including in the role of national lead counsel.

Mr. Sullivan has substantial trial experience in state and federal court. He has been a member of several trial teams in 'bet-the-company' and other high-profile litigation in which he has played a significant role in developing trial strategy, preparing company and expert witnesses, arguing evidentiary and other trial motions, and examining witnesses, including cross-examining adverse expert witnesses. He has actively managed and coordinated all stages of pre-trial preparation and proceedings, including numerous Daubert and Frye challenges.

He is a member of the firm's class action and commercial litigation steering committees and is a frequent writer and lecturer on class action litigation, federal jurisdiction, and other complex litigation issues.

Mr. Sullivan is a member of various national and local bar associations, including the Philadelphia Bar Association, American Bar Association, Defense Research Institute, and the University of Pennsylvania Inn of Court. He is also active in the firm's pro bono practice, and has handled professional responsibility and legal ethics matters. Mr. Sullivan is also a board member of several nonprofit organizations in the Philadelphia area. He is also active in the firm's recruiting efforts.

Prior to joining Morgan Lewis, Mr. Sullivan served a federal clerkship with Judge Anita B. Brody of the U.S. District Court for the Eastern District of Pennsylvania. He earned his Ph.D. in philosophy from the University of Pennsylvania in 2003, where he received the University's Outstanding Teaching Assistant Award. Mr. Sullivan received his J.D., cum laude, from the University of Pennsylvania Law School in 2001 and his M.A., with highest distinction, in moral, political, and legal philosophy from the University of Reading, England, in 1996. He earned his B.A., cum laude and Phi Beta Kappa, in philosophy from the College of the Holy Cross in 1995.

Mr. Sullivan is admitted to practice in Pennsylvania and Massachusetts.
