Warren Anthony Fitch

Tony Fitch’s practice focuses on three areas: defense of white collar criminal and government enforcement proceedings, complex commercial litigation and arbitration, and intellectual property litigation. Before entering private practice, Tony served for nine years as a trial and appellate lawyer and deputy director of the Public Defender Service for the District of Columbia. He has tried more than 50 jury trials; argued more than two dozen appeals; and handled numerous non-jury trials, arbitrations, professional credentialing and disciplinary proceedings, and contested regulatory proceedings.

In the white collar and government enforcement area, Tony serves as counsel for corporate and individual defendants in criminal and civil actions, state and federal regulatory investigations and enforcement proceedings, and professional disciplinary and credentialing proceedings. He recently represented a defendant in complex litigation arising out of contractual and other disputes with respect to petroleum concessions and other commercial enterprises in the Caucasus. Tony’s representations have included cases involving the Foreign Corrupt Practices Act (FCPA), civil and criminal securities fraud actions, civil RICO actions, Federal Election Campaign Act prosecutions, SEC formal and informal insider trading investigations, tax evasion prosecutions, CERCLA and Clean Water Act enforcement proceedings, RTC and FDIC actions against professional service providers including parallel proceedings, as well as internal investigations and actions arising under the Telephone Consumer Protection Act. He has successfully represented clients in the “III Wind” investigation, the FDA/DOJ generic drug industry investigation, the FDIC savings and loan investigation, the Enron investigation, and other criminal and regulatory investigations and enforcement proceedings at the state and federal level.

In the complex commercial litigation and arbitration area, Tony provides representation in executive compensation, business enterprise control, corporate governance, non-compete, employment termination and other corporate and partnership disputes. He currently has major litigation and case management responsibilities in the firm’s representation of one of the defendants in the multidistrict litigation arising out of the Gulf of Mexico oil spill.

In the intellectual property area, Tony’s work includes a successful trademark infringement action for the nation’s leading VoIP provider, a successful patent infringement defense of the developer of an innovative multichannel video service, the successful representation of a national standards-setting organization in several trademark and copyright actions and related proceedings, and the successful resolution of a patent infringement action involving call routing technology for VoIP telephone calls. He recently successfully represented through trial and an ensuing settlement two inventors and their public sector employer in a major patent royalty dispute arising out of a group of licensing agreements pertaining to a significant anti-viral medication.
