Allan A. Fanucci

Allan Fanucci is a partner in the firm’s intellectual property group who concentrates his practice on patent claim formulation and interpretation, primarily for chemical, mechanical, and pharmaceutical inventions for both large and small clients.

With 30 years of experience, Mr. Fanucci has been involved in obtaining more than 3,000 U.S. patents for client inventions in technology areas, such as food chemistry and related packaging technology, flavors and fragrances, pharmaceuticals and drug delivery systems, peptides, proteins and other organic and bio-organic compounds, organic polymers and elastomers, medical devices, automotive products, semiconductors, and electroplating solutions and processes. He reviews patent applications to assure that the claims are in compliance with U.S. patent laws, and he assists clients in obtaining patents by conducting personal interviews with patent office examiners.

In 2012, Mr. Fanucci was recommended by IAM Patent 1000 for his strong prosecution practice and described him as “a highly efficient operator” with “an in-depth understanding of many industrial processes and systems.”

In addition to patent prosecution, Mr. Fanucci has prepared all types of patent opinions, including validity, invalidity, infringement, and non-infringement, as well as opinions regarding the patentability of inventions and the valuation of intellectual property assets in connection with private placements and public offerings of securities. He also has prepared intellectual property assets and rights transfers, including acquisition and sale documents, assignments, licenses, confidentiality agreements, and joint venture/cooperative research project agreements.

Another facet of his practice consists of inter partes actions before the U.S. Patent Office, including patent interferences and reexamination proceedings. Mr. Fanucci also has supervised patent opposition and interference proceedings in Europe, Japan, and South Africa.

His representative patent prosecution clients include Silicon on Insulator Technologies SA, Nestec SA, Chicago Climate Exchange, and Firmenich SA.

Mr. Fanucci received a B.S. in Materials Engineering from Wilkes College in 1974 and an M.S. in Metallurgy from Stevens Institute of Technology in 1979. He received a J.D. from St. John’s University in 1982.
Activities

Mr. Fanucci represents unfunded independent inventors to obtain patents at minimal cost. He is a member of the Patent and Trademark Relations Committee of the American Intellectual Property Law Association; the New York Intellectual Property Law Association (Board of Directors); the Federal Circuit Bar Association; and Knight of Columbus Council #9210.
