Andrew Hruska

is a litigation partner in King & Spalding’s New York office and a member of the firm’s Special Matters and Government Investigations Practice Group. Mr. Hruska's practice focuses on criminal and regulatory litigation and investigations, complex civil and bankruptcy litigation, and internal investigations. Since leaving the Justice Department, Mr. Hruska has represented major financial service and industrial companies in enforcement investigations by the Justice Department’s Criminal Division, the U.S. Attorneys’ Offices for the Southern and Eastern Districts of New York, the United States Trustees Program, the SEC, the New York Attorney General’s Office, the New York County District Attorney’s Office, the New York State Banking Department, the IRS, the FTC, the Treasury Department’s Office of Foreign Asset Control, the New York Federal Reserve Bank, Department of Health and Human Services Office of the Inspector General, the U.S. Department of Labor, FINRA, the Export-Import Bank of the United States’ Inspector General, and the United Kingdom’s Financial Services Authority.

Mr. Hruska served as Examiner in the Granite Broadcasting bankruptcy in the Southern District of New York. Mr. Hruska has represented clients across the financial services spectrum, including securities, commercial banking, insurance, insurance brokerage, hedge funds, private equity funds and major industrial companies concerning criminal and civil enforcement in the areas of securities, foreign corrupt practices, banking regulation, international trade sanctions, false claims, taxation, antitrust, and immigration restrictions. Mr. Hruska consults with numerous multinational companies on a range of criminal and regulatory compliance issues.

Mr. Hruska has conducted numerous internal investigations concerning allegations of securities fraud, bank fraud, healthcare fraud and foreign corrupt practices for Fortune 500 companies.

Before joining King & Spalding, Mr. Hruska served as the Chief Assistant U.S. Attorney for the Eastern District of New York, overseeing both the criminal and civil divisions. In that capacity he supervised the office’s significant corporate fraud offensive, including the investigations of Computer Associates and Symbol Technologies. Mr. Hruska was appointed Acting United States Attorney for the prosecution of the New York Racing Association on tax conspiracy charges. Mr. Hruska personally led the criminal investigation of the fatal Staten Island Ferry crash of October 15, 2003 that resulted in the manslaughter conviction of New York City’s Ferry Service Director.

Previously, Mr. Hruska served as Senior Counsel to United States Deputy Attorney General Larry Thompson where he coordinated corporate fraud enforcement and policy department-wide. This included the revision of the Justice Department’s guidelines for corporate prosecution known as the “Thompson Memorandum,” the creation of the President’s Corporate Fraud Task Force initiative that harnessed the resources of the Justice Department and a range of regulatory agencies, and advised the Justice Department leadership and the Administration on the criminal provisions of the Sarbanes-Oxley Act. Mr. Hruska also coordinated the President’s Project Safe Neighborhoods nationwide anti-gun-violence program and received the Project Safe Neighborhoods Achievement Award from the Attorney General.

Prior to his federal service, Mr. Hruska served as an Assistant District Attorney in the Manhattan District Attorney’s Office’s Frauds Bureau, prosecuting major securities fraud, bank fraud and insurance fraud cases. Mr. Hruska served as a judicial clerk for the Honorable Ralph Winter of the U.S. Court of Appeals for the Second Circuit.

Mr. Hruska has tried criminal and civil cases in both federal and New York State courts. His trials that received significant public attention include United States v. Mui (E.D.N.Y. 2004) (complex tax fraud by an accountant), People v. Keyes (N.Y. Supreme Ct. 2000) (widespread insurance fraud targeting United Nations missions), People v. Wolf (N.Y. Supreme Ct. 1999) (bribery of insurance company insiders by plaintiffs’ attorney) and Bauchman v. West High School (D. Utah 1996) (religious liberty). He has argued in the Second and Tenth U.S. Circuit Courts of Appeals and the New York State Appellate Division, First Department.

Mr. Hruska graduated, cum laude, from Yale College and received his law degree from Yale Law School, where he was a John M. Olin Fellow in Law and Economics. He is a member of the bar of the State of New York, the Southern and Eastern Districts of New York, the Second, Tenth and D.C. U.S. Circuit Courts of Appeals and the United States Supreme Court. Mr. Hruska serves on the New York City Bar's Criminal Advocacy Committee and is a guest lecturer at Yale Law School on Securities Regulation, a guest instructor in trial advocacy for the New York County District Attorney’s office, a Yale Law School Alumni Executive Committee member and a frequent public speaker on white-collar criminal law and other law enforcement topics.
