Anthony N. Upshaw

Anthony (Tony) Upshaw is a partner in the law firm of McDermott Will & Emery LLP and is based in the Firm’s Miami office. He focuses his practice on class action, mass tort, product liability defense and complex civil litigation.

Tony was recognized for three consecutive years by the National Law Journal for obtaining a “top ten defense verdict” related to his defense of the tobacco industry. He was also named as a “Super Lawyer” in Super Lawyers magazine, Florida edition, in 2006, 2007, 2008, 2009, 2010, 2011 and 2012. Over the course of his career, Tony has tried more than 30 jury trials to verdict.

Tony is a frequent speaker at various legal association functions, particularly on issues surrounding trial technique and diversity in the courtroom. He was previously a featured speaker at the UIA Congress in Paris, France, presented the “Hot Topics in Product Liability Litigation” at the DRI Conference in New Orleans and testified at the hearings for the ABA Presidential Diversity Summit in Boston.

Tony is a former member of the Board of Governors of the American Bar Association and co-chair of the ABA’s Litigation Section Haiti Project. In 2013, he was appointed co-chair of McDermott's Racial & Ethnic Diversity & Inclusion Committee. Tony is also a member of the Firm's Finance Committee. He is a member of the Florida Bar, Miami-Dade County Bar Association and was formerly President of the Young Lawyers Section. Tony is also a member of the 11th Circuit Court Committee on Professionalism.

Tony is admitted to practice in Florida; the District of Columbia; the U.S. District Court for the Southern, Middle and Northern Districts of Florida; the U.S. District Court for the Eastern District of Wisconsin; and the U.S. Court of Appeals, Eleventh Circuit.
