Audrey Pumariega is an associate in the law firm of McDermott Will & Emery LLP and is based in the Firm’s Miami office. She is a member of the Trial Practice Group and focuses her practice on complex civil litigation. She also serves on the Firm’s Professional Responsibility Committee. Achieved dismissal with prejudice of right of publicity lawsuit brought by well-known actress over the use of her name in musicians’ international hit song.
Obtained total defense verdict based on fair use doctrine on behalf of prominent Spanish-language broadcast company in copyright infringement action brought by journalist.
Defeated dismissal of civil trade secrets action involving complex issues of first impression under the Computer Fraud and Abuse Act, Electronic Communications Privacy Act and Stored Communications Act.
Obtained dismissal of lawsuit brought against clothing manufacturer under Puerto Rico’s Sales Representative Act.
Obtained dismissal on behalf of hospital of lawsuit brought by radiologist alleging that hospital effectively terminated radiologist’s medical staff privileges without providing due process procedures proscribed by hospital’s bylaws.
Defeated motion for temporary injunction brought by physicians alleging that hospital breached its bylaws when it terminated physicians’ medical staff privileges upon replacing exclusive provider of hospitalist services.
Obtained injunction on behalf of largest dental implant company in the world against former sales representative who solicited the company’s customers in violation of his restrictive covenant.
Prevailed on important aspects of jury instructions that defeated plaintiff’s damages theory in False Claims Act action, leading to immediate resolution of the case.
Audrey is admitted to practice in Florida and before the U.S. District Court for the Southern District of Florida and the U.S. Bankruptcy Court for the Southern District of Florida.
Audrey is also an adjunct faculty member at Florida International University, where she co-teaches a Law & Jurisprudence course.

Audrey received her J.D., magna cum laude, from the University of Miami School of Law, where she was an articles and comments editor for the Inter-American Law Review and member of the Moot Court Board. She was also a member of the Order of the Coif. While in law school, Audrey was an intern for Justice Jorge Labarga of the Florida Supreme Court.
Audrey is experienced in complex commercial, products liability and intellectual property litigation.
Prior to law school, Audrey was an account executive for a national public relations and marketing agency and an internationally certified soccer referee.
