Brian A. Zemil

Brian Zemil has proven experience in complex litigation in areas of product liability, wrongful death, toxic tort, premises liability, asbestos and silica products, and insurance contracts. He litigates tort and commercial disputes in state and federal courts. He focuses on preparing cases for trial and has experience both in trying cases on his own and being part of a trial team for large mass tort cases.

With national counsel experience, Mr. Zemil manages and litigates mass tort cases, often pending in multiple jurisdictions. Mr. Zemil has first chair trial experience in state and federal courts. He has taken or defended over 500 fact and expert witness depositions. He is a skilled negotiator and has obtained favorable resolutions for clients. Mr. Zemil is also an experienced appellate advocate.

Significant Matters
As lead national and trial counsel, Mr. Zemil has directed nationwide mass tort silica litigation. Mr. Zemil implemented an early exit strategy that resulted in the dismissal of his client from all of its silica cased in the MDL.

Mr. Zemil argued before the Court of Appeals of Maryland, and through that appeal, successfully transferred over 200 cases to a jurisdiction more favorable to the client. In another recent appeal, Mr. Zemil argued to the United States Court of Appeals for the Fourth Circuit to support post-trial court rulings in a case Mr. Zemil tried to verdict.

Additionally, Mr. Zemil has successfully prosecuted a contribution claim against a co-defendant in each of the four product liability cases consolidated in a 28 day trial. He has also argued before the Court of Special Appeals of Maryland, and through that appeal successfully dismissed over 100 cases.

Activities
Nationally, Mr. Zemil serves as a Delegate to the American Bar Association. In Maryland, he has served two terms on the State Bar Board of Governors. Mr. Zemil is a Past Chair of the Maryland State Bar Association Young Lawyers Section. Mr. Zemil provides pro bono legal services to the community including successfully trying a prisoner’s rights case in federal court where a jury awarded punitive damages.
