Brian M. Ercole

Brian M. Ercole is an associate in Morgan Lewis’s Litigation Practice and a member of the firm’s Class Action Working Group. Mr. Ercole focuses his practice on consumer-based class actions and other complex litigation in the healthcare, pharmaceutical, medical device, food, and financial services industries. He regularly defends healthcare companies, pharmaceutical companies, food manufacturers, banks, retailers, and companies in the mortgage industry against putative class actions involving a wide array of claims, including civil RICO, TILA, breach of contract, fraud, and statutory unfair trade practices claims, in both state and federal courts across the United States. Mr. Ercole has handled all phases of litigation, including petitions before the Judicial Panel on Multidistrict Litigation, class settlement approval hearings, and appeals.

Prior to joining Morgan Lewis, Mr. Ercole served as a two-year clerk for Judge Legrome D. Davis of the U.S. District Court for the Eastern District of Pennsylvania. Mr. Ercole then served a one-year clerkship for Judge Jerome A. Holmes of the U.S. Court of Appeals for the Tenth Circuit.

Mr. Ercole earned his J.D., cum laude, from Temple University Beasley School of Law in 2003. While in law school, he served as a staff member for the Temple Law Review and as an officer of the Moot Court Honor Society. He earned his B.A., summa cum laude, with a concentration in literary theory, from the University of Delaware in 2000, where he graduated Phi Beta Kappa.

Mr. Ercole is admitted to practice in Florida, Pennsylvania, and New Jersey and before the Eastern District of Pennsylvania, the Southern District of Florida, and the U.S. Court of Appeals for the Tenth Circuit.
