Cary Miller

Cary Miller works with clients in the biotechnological and pharmaceutical areas. Her practice focuses on strategic patent procurement, general counseling on patent infringement and validity issues, USPTO post-grant proceedings, and patent litigation. Best Lawyers named Dr. Miller the “San Diego Biotechnology Law Lawyer of the Year” for 2013, an honor given to a single lawyer in the metropolitan area. She was also selected by her peers for inclusion in Best Lawyers in America 2014 and 2015.

Dr. Miller has drafted and prosecuted patents relating to novel nucleic acid and amino acid sequences, antibodies, cancer therapeutics and diagnostics, small molecules, human embryonic stem cells, plant genetic engineering, drug delivery devices, and biomedical devices. She has conducted intellectual property due diligence studies and has filed multiple patent term extension applications for drugs and medical devices. She has also drafted and negotiated license, materials transfer, and confidentiality agreements. Dr. Miller has participated in multiple biotechnology and pharmaceutical patent litigation lawsuits. Most recently, she has represented companies in generic drug litigation and in litigation relating to DNA sequencing.

Dr. Miller received her Ph.D. in biomedical sciences from Mount Sinai School of Medicine in New York. Her primary area of research was in cellular, developmental, and molecular biology, studying the roles of Wnt proteins in cell-cell interactions. Dr. Miller’s publications have appeared in Nature Genetics, Development, Mechanisms of Development, Journal of Cell Biology, and the American Journal of Human Genetics. She also co-authored a book chapter in The Endometrium.

Dr. Miller received her J.D. from Columbia Law School in 2002. While attending law school, she was a Harlan Fiske Stone Scholar and was managing editor of the Columbia Science and Technology Law Review. She received her Ph.D. in biomedical sciences from Mount Sinai School of Medicine in 1999, and a Class 1 bachelor’s degree in life sciences from Queen’s University at Kingston in 1993.

Prior to joining Morrison & Foerster, Dr. Miller worked at a law firm in Atlanta, Georgia. Dr. Miller is admitted to practice in California, Georgia, and before the U.S. Patent and Trademark Office.
