Chuck Hungerford focuses on environmental and land use issues. He represents companies to resolve investigations and enforcement actions initiated under environmental laws and works with companies to develop effective air, water, and hazardous materials compliance programs, including programs in such emerging areas as EPA's enhanced chemical safety program, California's green chemistry initiative, and federal and state climate change and greenhouse gas emissions programs. Chuck also identifies the land use entitlements and resource agency permits needed to support proposed land use projects and works with applicants to obtain the approvals.
Chuck currently is working with manufacturing, pharmaceutical, and consumer product companies on projects concerning a wide variety of environmental laws, including RCRA, import requirements under TSCA, brownfield development under CERCLA, VOC emission requirements adopted by the California air districts, California's Proposition 65, and CEQA. Chuck works with banks and investment groups to evaluate land use entitlements and to identify the status of approvals for existing collateral. His current projects include forbearance agreements, leases involving contaminated property, and the preservation of entitlements.
At the start of his career, Chuck worked at the U.S. Environmental Protection Agency enforcing requirements promulgated under the federal Clean Air Act. Prior to entering private practice, he was in-house environmental counsel for a major pharmaceutical company. Currently, Chuck is a member of the City of Sunnyvale Planning Commission and has served as chair and vice chair of the commission. He is active in several pro bono matters, including work with The Nature Conservancy and The National Audubon Society.
