David Marroso

David Marroso is a trial lawyer, a partner in O'Melveny's Century City office, and a member of the Business Trial and Litigation Practice. A successful defense of two US$200+ million lawsuits accusing the company of accounting fraud, mismanagement, and breach of fiduciary duty;
The prosecution of a defamation and extortion lawsuit against individuals who launched a highly-orchestrated internet attack on the company; and
The prosecution of a malpractice and breach of fiduciary lawsuit against Lennar’s former attorneys.
Global agricultural giant, Agrium, Inc. and its subsidiaries in multiple matters, including:
A precedent-setting antitrust matter alleging a worldwide conspiracy to manipulate the price of potash.
A US$100+ million breach of contract and tortious interference lawsuit involving “organic” fertilizer.
In connection with various agricultural and pesticide regulatory agencies.
International apparel juggernaut Guess? Inc. in multiple matters, including:
A highly-publicized trademark infringement trial in the Southern District of New York.
An arbitration against former licensees of the “Baby Guess” line and in defense of the licensee’s appeal.
A trademark action brought by the designer of high-end denim wear.
The Hollywood Foreign Press Association in a high-profile trial concerning the rights to the Golden Globes Awards Show.
Boxing promoter Top Rank, Inc., boxing superstar Manny Pacquiao, and former welterweight champion of the world Antonio Margarito in various matters, including breach of contract, defamation, and matters before various athletic commissions.
An entrepreneur and cricket enthusiast in a dispute against the United States of America Cricket Association concerning proper procedures for voting and elections under the Association’s Constitution.
Chinese manufacturing giant Midea in a breach of contract and intellectual property dispute against a domestic broker of products.

David also has represented:

Colony Capital in connection with disputes stemming from investments in the gaming and casino space;
Motown Records and its founder Berry Gordy in a malicious prosecution and royalty dispute lawsuits involving the company's former songwriters and producers;
Major television studio, ABC, Inc., in a first-of-its-kind copyright class action involving the use of music on television;
Represented a movie studio in an arbitration over credit rights to one of the highest-grossing motion pictures of all time;
Represented criminal defendant charged with robbing two banks;
First-chaired a successful arbitration on behalf of TOKYOPOP, Inc., one of the world's top producers of anime, against primary distributor for breach of contract and fraud; and
Second-chaired a week-long criminal jury trial for City of Redondo Beach which resulted in conviction of defendant.

David is an member of the Firm's pro bono Trial Advocacy program, Green Office Initiative, and Diversity Day Planning Committee.
