James S. Yoder

Jim Yoder focuses his practice on complex bankruptcy, commercial and insurance litigation. His extensive litigation experience includes but, is not limited to, cases involving insurance coverage, insured third party liability claims, as well as professional liability claims against directors/officers, attorneys, accountants and insurance brokers/agents. Jim also handles commercial/investment fraud cases, contract disputes, replevin actions, construction contract/defect cases, misappropriation of trade secrets, and partnership/shareholder disputes.

Jim represents secured/unsecured creditors and interested parties in a broad range of bankruptcy matters including, debtor reorganization/liquidation, creditor claim disputes, executory contract issues, lift stay motions, D&O claims, plan objections, adequate assurance disputes, administrative claims and prosecution/defense of avoidance actions. In bankruptcy court Jim represents distressed business entities, utility companies, municipal governmental entities, community development districts, school districts, corporate directors and officers, large and mid-size domestic and multinational corporations, insurance brokerage companies, commercial landlords and tenants, equipment lessors, institutional and other lenders, construction companies, aviation companies and trade creditors of virtually every kind. He also represents insurers in asbestos mass tort bankruptcy cases and in other bankruptcy matters affecting insurance companies.

Jim practices primarily in the state and federal courts of Delaware and Maryland. He is also licensed and actively practices in the state and federal courts of, New Jersey and Pennsylvania.

Jim is a Mediator, trained under the auspices of the Superior Court of Delaware, and on the panel of approved Mediators/Arbitrators for the U.S. Bankruptcy Court for the District of Delaware.

Prior to joining White and Williams, Jim was the Managing Director of the law firm of Tighe, Cottrell & Logan, P.A. in Wilmington, DE. He also served as a judicial law clerk to the Honorable George Farrell, III, Superior Court of New Jersey, Salem County. Jim is also a former adjunct faculty member at the University of Delaware Paralegal Certification Program.
