Global NAPs, Inc. v. Verizon New England, Inc. (D. Mass. 2008)
Successfully represented Verizon in a bench trial against a competitive local exchange carrier, obtaining a $60 million judgment.
Served as second chair for the litigation, selected the trial exhibits and deposition designations, dealt with evidentiary disputes, drafted examination outlines and prepared client witnesses for trial. Heavily involved with jury study work and handled pre- and post-trial briefing (including Final Pretrial Conference Order).
Garamendi v. Altus S.A. (C.D. Cal. 2005)
Successfully defended Francois Pinault and Artemis, the company he founded, in a four-month jury trial against the Insurance Commissioner of the State of California concerning the rehabilitation of Executive Life Insurance Company. The Commissioner, who was seeking more than $3.5 billion, was not awarded any actual damages by the jury.
Prepared in whole or substantial part more than ten examination outlines (direct and cross, factual and expert), was involved in selecting deposition designations for more than a dozen witnesses presented by transcript, and was deeply involved in preparation of expert witnesses. Also involved with jury study work and assisted with pre- and post-trial briefing.
In re ASARCO, LLC (S.D. Tex. 2010)
Successfully represented debtor's financial advisor in fee dispute bench trial conducted as an adversarial proceeding under the Bankruptcy Code. The financial advisors' fees were allowed in full and it was awarded a $1 million success fee after four days of trial.
Served as second chair for the litigation. Trial work including examination of three witnesses (one factual cross, one expert cross and one expert direct), and handling evidentiary disputes and related issues. Also involved in drafting examination outlines and preparing client witnesses for trial.
Mr. Myatt earned his Juris Doctor, cum laude, from the University of Wisconsin, where he was a member of the Order of the Coif. He received his Master of Science in Bacteriology from the University of Wisconsin in 2003 and his Bachelor of Science in Biology from Duke University in 1998.
Mr. Myatt is a member of the New York and Wisconsin bars, and the American Bar Association.
