Mr. Holder is a partner in the Business Trial and Labor and Employment Practice Groups in the Del Mar Heights office.

Mr. Holder is an experienced litigation attorney, with an emphasis on complex civil business litigation and labor and employment litigation, including class actions. In addition to handling civil litigation, Mr. Holder also counsels clients in connection with pre-litigation resolution of disputes and best practices in his areas of expertise.

Mr. Holder’s many valued clients include well-known companies in the insurance, sporting goods and apparel, consumer electronics, aerospace and aviation, construction, life sciences, and automotive industries, among many others.

Mr. Holder's complex civil business litigation experience includes the following:

Representing aviation industry client in action involving competing claims for breach of contract, breach of warranty, fraud, defamation, trade libel, and interference with prospective economic advantage;
Defending nationwide insurance brokerage client in numerous related matters alleging violation of the California Insurance Code, unfair business practices, breach of contract, breach of fiduciary duty, and fraud, including attempts to pursue representative or class relief;
Defending major insurance company in class action alleging violation of California Penal Code section 632 (recording or monitoring calls without consent);
Defending technology company against claims for misappropriation of trade secrets and copyright infringement;
Defending sporting goods company against claims alleging interference with contract;
Defending several major law firms against complex legal malpractice claims, including attempts at a class action;
Representing nationwide gas distributor in actions involving competing claims for products liability, breach of warranty, and indemnity;
Defending major aerospace company in action alleging breach of contract;
Representing real estate developers and contractors in disputes alleging claims for breach of contract, negligence, construction defect, fraud, and interference with contract;
Defending consumer goods manufacturer against claims alleging improper use of “Made in the U.S.A.” designation;
Defending a major auto manufacturer against claims of breach of contract and fraud;
Defending a major oil and gas company against claims of alleging wrongful death and negligence in a foreign country; and
Defending a Fortune 10 executive against claims alleging criminal conspiracy and securities fraud.

Mr. Holder's labor and employment experience includes the following:

Defending sexual harassment lawsuits, including both hostile work environment and quid pro quo;
Defending lawsuits alleging various forms of discrimination, including age discrimination, gender discrimination, and disability discrimination;
Defending retaliation and whistle-blower lawsuits;
Defending wage and hour lawsuits, including class actions alleging meal period and rest break violations, failure to pay for all hours worked, failure to pay at the proper rate, reporting time violations, and waiting time penalties;
Defending breach of contract claims, including implied contracts to not terminate absent good cause;
Defending lawsuits alleging failure to pay prevailing wages;
Defending lawsuit alleging failure to make pension and health contributions under ERISA;
Representing clients in obtaining TRO’s and injunctions against workplace violence and civil harassment;
Defending unfair labor practices charges before the National Labor Relations Board and its Regional Offices, including through the exceptions process to the Board in Washington, D.C.;
Advising clients regarding compliance with collective bargaining agreements;
Advising clients in connection with strategy and compliance during union election campaigns;
Advising clients in connection with work place investigations and wage and hour compliance;
Reviewing contracts and employment policies; and
Providing training, including regarding harassment and discrimination in the workplace.
