Phillip R. Maltin

Phillip R. Maltin is a partner in the Employment and Business Litigation groups in the Lathrop & Gage Los Angeles office. He is known locally and nationally as an outstanding litigator and exceptional questioner, with strong tactical and technical skills at trial. One key to his success is that he works in reverse, learning the outcome his client wishes to accomplish and developing the strategy, and case staffing, to achieve it.

In business disputes, Mr. Maltin handles lawsuits against one, or several, opposing parties. In addition, he has years of experience defending businesses against class-action claims. He represents corporations in all forms of business litigation, including claims involving breach of contract, breach of fiduciary duty and interference with economic advantage. He has years of experience representing corporations in shareholder derivative actions, and has the rare distinction of having recovered millions of dollars for several businesses victimized by civil fraud and embezzlement.

In employment matters, Mr. Maltin defends employers in lawsuits against single plaintiffs but focuses on multi-plaintiff litigation and class actions. He defends companies in a broad range of matters, including wage and hour, discrimination, harassment, retaliation and discrimination, wrongful termination and misappropriation of trade secrets. He also has conducted and managed numerous internal investigations for companies involving the entire range of work-place issues, from claims of discrimination and harassment to inquiries into violence and embezzlement. He frequently speaks on investigation and questioning techniques, with a focus on uncovering dishonesty. His presentations have sparked media interest, prompting frequent invitations to deliver keynote addresses at conferences and conventions across North America.

Mr. Maltin regularly acts as outside general counsel for businesses of all sizes and supplies day-to-day human resources counseling and strategy. His clients include national and international corporations located in the United States, Asia and Europe.

Mr. Maltin participates in the prestigious Fellowship program of the Trial Advocacy Project (“TAP”), where he is a fully credentialed instructor. He is a former full-time prosecutor (trial lawyer) in the Los Angeles City Attorney's Office, and continues to prosecute discrete criminal cases through trial as part of his commitment to the TAP program.

Mr. Maltin is perennially recognized as a Southern California Super Lawyer, an elite distinction given to no more than five percent of the Southern California Bar.
